Terms of Sale
 
Please read these terms and conditions carefully, they should read in conjunction with my about me page and postage page. These are not intended to be a full legal document, but to further clarify details contained within this website.
 

The Important Legal Part 

Terra Firma Studios is the trading name of myself, Andrew Saunders. I am registered as a Sole Trader. Currently my business operates below the UK VAT threshold, and no VAT is therefore charged on my sales at present.

 

All sales are bound by the terms of this contract to the exclusion of all others.  Any variation must be agreed by us in writing prior to acceptance of any order.  These Terms & Conditions are governed by the laws of England and both parties agree to submit to the exclusive jurisdiction of the English Courts.

 
Terra Firma Studios accepts no liability for consequential losses incurred as a result of use, misuse, abusive or for loss or damage in transit, for any product it sells.  I expect my customers to be sensible enough to use the products for their intended purpose and avoid using them in ways which are hazardous to themselves or others.  All of my products are for external use only, and as such are not intended for any use other than scenic layouts.
 
My maximum liability in all cases is limited to the value of items paid for and shipped.
Payment 
My current preferred method for receiving payment is through Paypal. 

I am happy to accept cheques & postal orders from U.K. purchasers. However in order to protect myself, for payments by cheque I will only ship when your cheque clears. This can take up to 10 days; despite banks making funds available in 3 days, I have found out the hard way that cheques can be returned unpaid anything up to 10 days later.  

 

If you collect in person I am happy to accept cash payments, in GBP.

 

Purchases by customers under 16 are very welcome, but must be with the full knowledge and consent of your parent or guardian (and also the account holder of the account being used if being paid on behalf of the customer, eg with a Paypal account or cheque.


Shipping

 I always make sure goods I ship have adequate insurance cover.  If something doesn't arrive, don't hesitate to contact me, I can then put things right for you (contact the courier, send replacement goods etc). I will also put a claim in with the Royal Mail, I will also send you a claim form to complete to help with the process. 


International Orders

International customers are welcome, but please be aware that YOU are responsible for any customs duties levied. EU countries do not levy customs duties on each other. I will not mark any items as a gift or sample so please do not ask.

I only accept paypal as a payment method for overseas customers.

Inspection and Returns 

Please inspect your purchases thoroughly when you receive them.  If the packaging appears damaged on arrival, please sign for it "unchecked" and advise the delivery driver or postman.  All claims for damage or part-loss in transit must be advised to me by email within 24 hours of delivery.  This is to enable me to meet the deadlines I am set to claim from the Royal Mail or courier company.

 

I will, of course, replace items with manufacturing faults.  Notify me by email as soon as you receive the goods, and I will then advise of the process.  My normal policy is to ask you to return the goods to me, and I will ship out a replacement as soon as I receive the return back.

 

I aim to follow, and try to exceed, Distance Selling Regulations.  I always allow at least 14 days between confirming your order and accepting your deposit as a cooling off period on terrain commissions. 

 

I will accept returns on any unused and un-damaged items purchased (except a comissioned layout). If you wish to return an item then return postage is at your cost and must be by trackable means. You will also be charged a 25% restocking fee to cover my costs deducted from any refund. The important thing, though, is clear communication.  Contact me if you wish to return an unwanted item.

 

I do not accept returns on comissioned layouts, this does not affect your statutory rights.


 

Privacy Policy

I will never knowingly give or sell your information to any third party. I cannot be held responsible if, despite my best efforts, my computer system is subject to attack by virus, trojan or other hostile program, or if Microsoft, or Paypal (who host my website and checkout) use the information they hold.  I maintain up-to-date and licensed anti-virus and anti-spyware software. 

 

I reserve the right to store information to assist me in the event of any query from the authorities ( i.e.if I get a Tax investigation or Customs enquiry ) I abide by the rules, and will only reveal such information if directly requested by the authorities, and will stress the need for privacy. I take your privacy as seriously as I take my own.  

The one exception to the above is that where you give me your telephone number to facilitate courier delivery, I have to give this to the couriers, in order solely that they can contact you for directions or in the event of delivery problems.  They should not use this information to call you for any other reason.  If they do, please inform me. 

 

I do not currently take payments directly by credit card, and therefore do not store any such information, and confidential information held by Paypal is not accessible to me. 

 

I will use email addresses I hold responsibly.  They will NEVER be sold to third parties, and although I may send individual emails, I do not carry out mass mailings unless I have your explicit consent.

 
I am happy to advise you of all information I hold about you on written request.  However, I will take steps to confirm that you really are the person who's information is being requested (this will be in the form of asking questions to which only a genuine customer would know the answers).  I reserve the right to levy a small charge to cover the administrative time for this.
